Financial & Legal Tools Frequently Asked Questions

  • What is a durable power of attorney?

This document allows you to appoint someone to manage your financial affairs (pay bills, sell property, manage taxes) if you become mentally or physically incapacitated.

  • What is an advance healthcare directive?

This combines a living will and a medical power of attorney. It specifies your end-of-life wishes and names someone to make medical decisions for you if you cannot speak for yourself.

  • Who makes decisions if I become incapacitated?

Without a plan, your family must go to court for a Conservatorship—a public, expensive, and often slow process. With a plan, your named agents in your Power of Attorney and Trust take over immediately.

  • How do I plan for long-term care costs?

We look at several strategies, including long-term care insurance, asset protection trusts, or specific Medi-Cal planning.

  • What is estate tax and will I have to pay it?

The Federal Estate Tax is a tax on the transfer of your estate. As of 2024, the exemption is very high (over $13 million per person), so most people don't pay it. However, these laws change, and we plan for future "sunsets" of these high limits.
